This document is published in accordance with the provisions of Rule 3 (1) of the Information Technology (Intermediaries Guidelines) Rules, 2011 that require publishing the rules and regulations, privacy policy and terms and conditions for access or usage of www.polkistories.com

This Website is owned and operated by Raniwala Jewellers Private Limited (hereinafter “Raniwala 1881”, “RJPL” or the “Company”). By using our Website, you accept these Terms and Conditions in full; accordingly, if you disagree with these Terms and Conditions or any part of these Terms and Conditions, you must not use our Website. RJPL reserves the right to change these Terms and Conditions from time to time without any obligation to inform you, and it is your responsibility to look through them as often as possible. All rights, including copyright, on this Website are owned by or licensed to RJPL. Any use of this Website or its contents, including copying or storing it in whole or part is prohibited without the permission of RJPL.

2. Eligibility Criteria

Any use/purchase/contract from/with this Website is not intended for users under the age of 18, unless permitted under applicable local laws (“Permissible Age”). Accordingly, by using our Website or agreeing to these Terms and Conditions, you warrant and represent to us that you are of the Permissible Age. We do not knowingly provide any service of the Website from users or solicit information from anyone below the Permissible Age. If we become aware that any person below the Permissible Age is using the Website, we will restrict the access of the Website to such users as soon as possible. Those who choose to access this Website from outside India are responsible for compliance with applicable national laws and the Indian laws.

4. Pricing & Payment

Prices throughout the Website are quoted in one of the following currencies: Indian Rupees (INR), US Dollars (USD), Great Britain Pound (GBP), Euro (EURO) & Dirham (AED). Payment can only be accepted in quoted currency. Prices mentioned from time to time shall exclude all indirect taxes including VAT (Value Added Tax)/GST (Goods and Services Tax).

For International deliveries, additional duties and taxes may be applicable for the ordered items as per your country regulations, which will be billed separately to you by the courier/transporter company at the time of delivery.

Prices of the products on the Website are subject to change without notice, and can vary from piece to piece, design to design, and from time to time, depending on the price of raw materials at the time of production. Gold, silver and precious stones are commodities, with market fluctuations beyond our control. Occasionally, a piece will sell, and then be recreated or remanufactured at a later date with a difference in price. This simply reflects the market value of the raw materials and may not mean that we have increased our mark-up.

5. Pricing Policy for online Merchandise

We are committed to offering shopping convenience, exceptional service and an exciting product selection at competitive prices. We price our jewellery on the weight of material used, rarity of the precious stone, and also on the level of craftsmanship involved. For most or all of the products you shall be paying standard making charges which shall be subjected to changes upon market situations, provided that no information regarding such change shall be provided to you. All the variations in price for online merchandise shall only be visible on the website. The products and prices offered at each interval may differ and vary. The Website may offer products which are not offered in stores. For example, A gold bracelet may be priced differently in the stores than on the Website. Similarly, promotional offers (such as coupons and additional discounts) offered at one may not be used at the others.

6. Online Payment

All payments on the Website are securely processed through our payment gateway partner. We accept credit and debit cards including Visa, MasterCard, American Express­ and Razorpay. By placing an order on the website, you warrant that:

(i) all the payment information provided by you is true and accurate;

(ii) the credit/debit or any other card you use to pay your order has sufficient fund, and is active and has not expired.

(iii) you are the holder (or authorized user) of the debit/credit or another card, mentioned above, which you use to pay for your order, and you authorize the full transaction amount of your order to be charged to your designated card. We may accept bank transfers upon special request at our sole discretion. You can contact our customer care for the same. However, your card may be declined if (i) the billing information given does not match with the cardholder records, (ii) your card has expired or cancelled, or (iii) a potential fraud or threat is detected on your card. We endeavor to ensure confirmation of ordered item(s), availability and shipping before processing your order transaction. You will be intimated by email if we are unable to complete your order.

7. Order of Products

All products and information displayed on the Website constitute an invitation to offer. Your order for purchase constitutes your offer, which shall be subject to the Terms and Conditions as listed herein. We reserve the right to accept or reject your offer in part or in full. Our acceptance of your order will take place upon dispatch of the product(s) ordered. Dispatch of all the product(s) ordered, may or may not happen at the same time, in such a scenario that portion of the order which has been dispatched will be deemed to have been accepted by us and the balance would continue to be on offer to us and we reserve the right to accept or reject such balance order.

No act or omission of RJPL prior to the actual dispatch of the product(s) ordered will constitute acceptance of your offer. If you have provided us with your email address, we will notify you by email as soon as possible to confirm receipt of your order, and email you again to confirm dispatch and therefore acceptance of the order.

We have made every effort to display as accurately as possible the colors of our products that appear on the Website. However, as the actual colors you see will depend on your monitor, we cannot guarantee that your monitor's display of any color will accurately reflect the color of the product on delivery. All products are either machine made or handcrafted or combination of both, so there may be some variations in the actual product received. Packaging of the product may vary from the packaging of the product displayed on the Website.

All products are subject to availability. We reserve the right to limit the quantity of products we supply, supply only part of an order or divide up orders. We will inform you if we are unable to fulfill your order.

8. Made to Order: Terms & Conditions

We now ship to over 220 countries worldwide. Register with us to receive updates on shipping, promotions and other related information.

The shipping amount of a made-to-order item will depend on the value of the product, as given below:

8.1. Domestic Shipment (within India):

 

8.1.1.Free Shipping:

We offer free standard shipping in India.

8.1.2.Delivery Method:

All orders will be shipped through Standard Shipping via our official logistics partners within 7-10 business days. In rare cases, a slight delay might be caused due to unforeseen circumstances (or) any change in government policies, etc.. Shipping & delivery to Metro cities or locations will be faster.

8.1.3.Goods & Service Tax(GST):

Will be charged as applicable (from time to time) on the sale consideration value of goods sold. Currently, GST is chargeable at 3%.

8.2. International Shipment (Outside India):

8.2.1.Standard shipping will be free for orders above sale value $2500. But for orders below sale value $2500, applicable standard shipping will be chargeable. Shipping Charges are based on shipping destination and weight of your parcel. Shipping charges and transit time may vary, depending on the delivery location/destination. All international packages are shipped via our official logistics partners/authorized courier agents. All deliveries of goods-in-transit will be done from Monday to Friday (usual international market’s working days). International delivery cannot be guaranteed within a time frame due to customs clearance, documentation and other formalities.

8.2.2. Priority shipping is always chargeable. The amount may increase or decrease based on the sale value of goods, weight and delivery destination of the shipment.

8.2.3. Indirect Taxes such as import duty, GST, VAT, tariffs, duties, taxes, cess, octroi, handling fees, custom clearance charges, etc., as applicable, as per the laws and regulations of the importing/destination country, will be borne by the customer on or above the sale value of the goods (as the case may be) . We do not collect these taxes beforehand, and cannot give you an estimate of the cost to be incurred, because it varies widely around the world.

8.2.4. International shipment may require 10-15 business days or more additional processing time before shipment.

8.2.5. For international shipments, we do not accept returns, exchanges or refunds. Goods once sold in the international market are final and will not be taken back in any case.

8.2.6. 8.2.6. If you have selected any product that cannot be shipped to your home country or destination, we will inform you via email.

9. Return & Exchange (applicable in India only)

We want you to be happy with your purchase and we apologize if it is not. For whatever reason that you are not satisfied, we would be most happy to provide exchanges and returns for all items purchased from us if the following conditions are met:-

  • All items must be in their original packaging with product tags intact.
  • All items must be unworn and it must be in its original condition;
  • Originals receipts would need to be included.

Steps to making a return

  1. For any return, please inform us promptly or within three (3) business days from the date of receipt of your order with a video clip and necessary photographs (necessary for RJPL’s verification purpose). You must inform/notify us for the same by sending an e-mail on help@raniwalajewellers.com
  2. Before we arrange for your product return (mentioning the reason of goods return) to us, you are compulsorily required to send us necessary video clip and photographs of the goods. Our quality control (“QC”)/product team shall verify the same. Then it is up to the discretion of the RJPL’s QC/product team to decide whether the product is approved for return or not.
  3. Product can be returned within ten (10) days [inclusive of three (3) business days of notification period as per Step I, mentioned hereinabove] from the date of receipt of goods at customer’s end, only if goods are found suitable for return as per our terms, conditions & policies mentioned herein.
  4. Once we are in receipt of your e-mail and our product/QC team has approved the return, we will arrange for our official logistics partners/authorized courier agent to collect the goods and return them to us.
  5. RJPL will replace the items free of charge if possible or issue a refund for the purchase price of the goods to the credit/debit card used for online shopping. We will refund the purchase price of the jewellery and the shipping charges. Refunds will only be made after we have received the shipment in its original packaging.
  6. The purchase can be returned within 48 hours after delivery. 35% will be deducted from the invoice. GST / Taxes & duties are not refundable.

Note: We are not liable for any returns for which we have not been notified about within three (3) business days from the date of product received by a customer.

Eligibility criteria for refunds:

  1. Genuine quality issues.
  2. Packages lost in transit.
  3. In case RJPL discovers that a wrong product has been shipped to a customer and the same is returned to us.

No refunds will be given in the following cases:

  1. Incorrect or outdated delivery address.
  2. Incorrect address format including any form of a PO Box address.
  3. After 3 failed delivery attempts by our official logistics partner or an authorized third party courier agent.
  4. Package refused by recipient/customer.
  5. Products returned in a used or damaged condition.
  6. Minor color and design variation. All products are handmade and use natural stones, so there may be some variations from the photographs available on our website and actual product in hand.
  7. If the jewellery is defect free, without any fault or damaged.
  8. In all of the above cases, the customer needs to notify/inform us within three (3) business days from the date of receipt of goods at customer.

10. Delivery Schedule

The delivery of your order will be made as per your shipping address, details & information submitted and available with RJPL at – Shipping Details.

Alternatively, you could go to your “Order Status” section and determine the status of your order using your respective tracking number /airway bill number which shall be provided to you via email/SMS on your given email account ID or contact number (as the case may be), upon successful completion of the payment

11. Customer’s or Buyer’s Obligations

11.1. You must provide true, accurate, current and complete information about yourself as prompted by RJPL's registration form.

11.2. Upon change or inaccuracy of any information provided by you on the Website, you shall be responsible to promptly inform RJPL.

11.3. To maintain and promptly update the registration data to keep it true, accurate, current and complete. If you provide any information that is untrue, inaccurate, incomplete, or not current or if RJPL has reasonable grounds to suspect that such information is untrue, inaccurate, and not current or not in accordance with these Terms and Conditions, we have the right to indefinitely suspend or terminate your membership and refuse to provide you access to the Website.

11.4. In the event that a non-delivery occurs on account of a mistake by you (i.e. wrong or incorrect name or address or any other wrong information), the re-delivery of the same will made as per shipping information submitted and available with RJPL at – Shipping Details.

11.5. You will provide authentic and true information in all instances where such information is requested of you. RJPL reserves the right to confirm and validate the information and other details provided by you at any point of time. If upon confirmation your details are found not to be true (wholly or partly), RJPL has the right in its sole discretion to reject the registration and debar you from using the services of the Website and or other affiliated websites without prior notice whatsoever.

11.6. That before placing an order you shall check the product description carefully. By placing an order for a product, you agree to be bound by the conditions of sale and invitation of offer included in the item's description.

11.7. You shall not attempt to gain unauthorized access to any portion or feature of the Website, or any other systems or networks connected to the Website or to any server, computer, network, or to any of the services offered on or through the Website, by hacking, password ‘mining’ or any other illegitimate means.

12. Restrictions

We (RJPL) reserves the right, at our sole discretion, to limit the quantity/value of the items purchased by you and such restrictions may be applicable to orders placed by the same account, the same credit/debit card, and also to orders that use the same billing and/or shipping address. We will provide notification to the customer/buyer should such limits be applied. RJPL also reserves the right, at our sole discretion, to prohibit sales to any one as it may deem fit.

13. Site Security

You are prohibited from violating or attempting to violate the security of this Website, including, without limitation:

13.1. Accessing data not intended for you or logging into a server or an account, which you are not authorized to access.

13.2. Attempting to probe, scan or test the vulnerability of a system, network or breach security or authentication measures without proper authorization.

13.3. Attempting to interfere with service to any other user, host or network, including, without limitation, via means of submitting a virus to the site, overloading, and “flooding”, “spamming”, “spoofing”, “mail bombing” or “crashing”.

13.4. Sending unsolicited emails, including promotions and/or advertising of products or services.

13.5. Forging any TCP/IP packet header or any part of the header information in any email or newsgroup posting violations of system or network security may result in civil or criminal liability. RJPL will investigate occurrences that may involve such violations and may involve, and cooperate with law enforcement authorities in prosecuting users who are involved in such violations. You agree not to use any device, software or routine to interfere or attempt to interfere with the proper working of this site or any activity being conducted on this site. You agree, further, not to use or attempt to use any engine, software, tool, agent or other device or mechanism (including without limitation browsers, spiders, robots, avatars or intelligent agents) to navigate or search this site other than the search engine and search agents available on this site and other than generally available third party web browsers (e.g., Microsoft Explorer, Google Chrome, Mozilla Firefox).

14. Cancellation by RJPL

There may be certain orders that we are unable to accept and must cancel. We reserve the right, at our sole discretion, to refuse or cancel any order for any reason. Some situations that may result in your order being cancelled include limitations on quantities available for purchase, inaccuracies or errors in product or pricing information, or problems identified by our credit and fraud avoidance department. We may also require additional information or verification/s before accepting any order. We will inform you if the entire order or any portion of your order is cancelled or if additional information is required to accept your order. If your order is cancelled after your credit/debit card has been charged, the said amount will be reverted to your card account.

We will seek authorization on your card for the aggregate amount of the order placed by you, however, we may charge your card (capture) only with the amount corresponding to the actual portion of the order that we are able/willing to fulfill, and any associated shipping charges/taxes and levies etc. Any surplus amount, for which we might have originally sought and received an authorization on your card from your Card Issuer, if not captured by us in the time period stipulated by our Merchant Banker, will not be captured/ charged. If, however, the same is charged to your card/bank account in error, we will refund it as soon as the same is realized by us or brought to our notice, whichever is sooner. RJPL reserves the right to capture/charge your card to the full or partially authorized amount for the concerned order.

15. Cancellation & Changes by Customer

Cancellations, replacements and returns shall be governed by the Return and Exchange policy available at Raniwala Website –polki-stories.com/returns-exchanges.

It is agreed by you that you will not dispute the decision made by RJPL and accept the RJPL decision regarding cancellation, modification or replacement of the order.

16. Sales & Promotion

All offers for sale on the Website shall be subject to the following conditions:

16.1. The products under sale will be available only till the availability of stock with RJPL. Duration of sale is at the sole discretion of RJPL and it reserves all the rights to extend or terminate the sale, without further information at any point of time.

16.2. The products under the sale may be removed/changed/added by RJPL and the discounted prices can also be changed, at sole discretion of RJPL.

16.3. Any return or exchange of the products will be as per our return and exchange policy applicable at Raniwala Website – returns-exchanges.

16.5. RJPL reserves the right, at any time, to amend/add/remove/modify (in whole or part) any of the terms & conditions of sale, or to replace, wholly or in part, this promotion by another promotion, whether similar to this promotion or not, or to withdraw it altogether, and Raniwala 1881 decision in this regard shall be final and requires no intimation to the customer of any sort.

Polki Stories(referred to as “RJPL” or the “Company” or “we” or “us” or “ours”) is committed to protecting and respecting your privacy when you are using any of our products or services.

This privacy policy (together with the Terms and Conditions which can be found on the website) explains what types of personal and non-personal information we collect when you use the website and the basis on which any personal data we collect from you, or that you provide to us, will be processed by us with regards to opening and maintaining an account with us.

May share collective information such as demographics and Website usage statistics with our sponsors, advertisers or other third parties (such third parties do not include RJPL’s marketing partners and network providers). When this type of information is shared, such parties do not have access to your Personal Information.

17.2.3. With our subsidiaries, affiliates or group entities, if any.

We are also confirming and following the guidelines provided in draft Personal Data Protection Bill, 2018 as well as adhering to the Data Protection Act, 1998 to extend our services to you and shall adhere to consent based processing of your data we collect.

18. Profanity Policy

RJPL prohibits the use of language that is racist, hateful, sexual or obscene in nature in a public space. This policy extends to your submissions, postings and all other areas of the Website that another user may view. Please report any violations of this policy for review to the grievance officer mentioned in these terms and conditions.

If a feedback, comment, suggestion or any communication by or between customers or users on the Website; or email communication between Users contains profanity, please review our feedback removal policy and submit a request for action/removal.

However, in some special circumstances, Raniwala Jewellers at its discretion will consider its liability for your order up to a maximum limit of purchase price of the order.

24. Unforeseen Circumstances or Force Majeure

Force Majeure means any event or combination of events or circumstances beyond the control of RJPL which cannot (a) by the exercise of reasonable diligence, or (b) despite the adoption of reasonable precaution and/or alternative measures be prevented or caused to be prevented, and which materially and adversely affects a RJPL’s ability to perform obligations under this agreement including:

24.1. Acts of God i.e. fire, draught, flood, earthquake, epidemics and other natural disasters;

24.2. Pandemic situations or circumstances like Novel COVID-19, etc.;

24.3. Explosions or accidents, air crashes and shipwrecks

24.4. Strikes, lock-outs, civil disturbances, curfew etc.;

24.5. War or enemy action or terrorist action;

24.6. Change in Law, Rules and Regulations, injunctions or stay granted by court of law or interim order by Arbitrator;

24.7. Non-availability of raw material and/or spare parts or other material or water supply or electric power or like; or

24.8. Any event or circumstances analogous to the foregoing which is beyond the control of RJPL;

Promptly in three (3) days, upon the occurrence of any event mentioned herein above which may result in all delay in the performance of any act or deed, RJPL shall notify in writing thereof to you through an email/SMS, which notice shall identify such occurrence and specify the period of delay which may reasonably be expected to result therefrom

Any delay resulting from any such force majeure cause shall extend performance or deliverables dates to the extent caused thereby accordingly.

25. Indemnity

You shall indemnify, keep indemnified, saved, defend and hold harmless RJPL, its promoters, owners, board of directors, licensee, affiliates, subsidiaries, group companies (as applicable and/or as the case may be) and their respective officers, directors, employees and agents, from any claim or demand or actions including reasonable attorneys’ fees, made by any third party or cost, damages, penalty imposed or claimed due to or arising out of your breach of these Terms and Conditions, privacy policy and other policies, or your violation of any law, rules or regulations or the rights (including infringement of intellectual property rights) of a third party.

26. Intellectual Property Rights

RJPL, together with our licensors, owns the copyright to all the contents of this Website, including images. All trademarks and other intellectual property are owned by or licensed to us (unless otherwise specified).

You shall agree to purchase and maintain throughout the usage of this website or Agreement a technology/professional liability insurance policy, including coverage for network security/data protection liability insurance (also called “cyber liability”) covering liabilities for financial loss resulting or arising from acts, errors, or omissions, in rendering technology/professional services or in connection with the specific services described in this Agreement:

27.1. Violation or infringement of any right of privacy, including breach of security and breach of security/privacy laws, rules or regulations globally, now or hereinafter constituted or amended;

27.2. Data theft, damage, unauthorized disclosure, destruction, or corruption, including without limitation, unauthorized access, unauthorized use, identity theft, theft of personally identifiable information or confidential corporate information in whatever form, transmission of a computer virus or other type of malicious code; and participation in a denial of service attack on third party computer systems;

27.3. Loss or denial of service;

27.4. No cyber terrorism exclusion;

Such coverage must include technology/professional liability including breach of contract, privacy and security liability, privacy regulatory defense and payment of civil fines, payment of credit card provider penalties, and breach response costs (including without limitation, notification costs, forensics, credit protection services, call center services, identity theft protection services, and crisis management/public relations services). Such insurance must explicitly address all of the foregoing without limitation if caused by any third party, performing services under this Agreement. Policy must provide coverage for wrongful acts, claims, and lawsuits anywhere in the world. Such insurance must include affirmative contractual liability coverage for the data breach indemnity in this Agreement for all damages, defense costs, privacy regulatory civil fines and penalties, and reasonable and necessary data breach notification, forensics, credit protection services, public relations/crisis management/force majeure, and other data breach mitigation services resulting from a breach of confidentiality or breach of security.

28. Term & Termination

The terms and conditions of this agreement and your right to use the website will take effect at the moment you click “I ACCEPT” or you install, access, or use the Website and is effective until terminated as set forth below. These terms and conditions will terminate automatically if you click “I REJECT”. In addition, RJPL reserves the right at any time and on reasonable grounds, which shall include, without limitation, any reasonable belief of fraudulent or unlawful activity or actions or omissions that violate any term or condition of this agreement or policies, to deny your access to the website or to any portion thereof in order to protect its name and goodwill, its business, and/or other Authorized Users, and this agreement, its terms and conditions including policies will also terminate automatically if you fail to comply with them, subject to the survival rights of certain provisions identified below.

Termination will be effective without notice. You may also terminate this agreement at any time by ceasing to use the website, however all applicable provisions of this agreement will survive termination, as identified below.

31. Waiver:

The waiver of any default or breach under this agreement by RJPL shall not constitute a waiver of the right to terminate this agreement for any substantial default of a similar nature or under any other terms and conditions or policies of this agreement.

32. Governing Law & Jurisdiction

These Terms and Conditions shall be construed in accordance with the applicable laws of India. The Courts at Jaipur, Rajasthan shall alone have exclusive jurisdiction in any proceedings arising out of this agreement.

33. Amendment of Terms and Conditions

Subject to the contrary provision of the Information Technology Act, 2000, RJPL reserves all the rights, at any time to modify, amend, renew and alter the Terms and Conditions without any prior notification to you. Subsequent to any such modification of the Terms and Conditions, we will inform you of the modifications in the Terms and Conditions through email at the email address provided by you while registering on the Website. You can access the latest version of the Terms and Conditions at any given time on the Website. You should regularly review the Terms and Conditions on the Website. In the event the modified Terms and Conditions are not acceptable to you, you undertake to discontinue using the service. However, if you continue to use the service you shall be deemed to have agreed and accepted to the modified Terms and Conditions and you undertake to abide by the modified Terms and Conditions.

34. Arbitration

Except as explicitly stated otherwise, any notices shall be given by postal mail to RJPL’s Registered Office at 1, HawaSadak Road, Geejgarh Vihar Colony, Civil Lines, Jaipur – 302006 Rajasthan, India or to the email address you provide to us during the registration process (in your case). Notice shall be deemed given 24 hours after email is sent, unless the sending party is notified that the email address is invalid. Alternatively, we may give you notice by certified mail, postage prepaid and return receipt requested, to the address provided to us during the registration process. In such case, notice shall be deemed given seven (7) days after the date of mailing. If any clause of this Agreement shall be deemed invalid, void or for any reason unenforceable, such clause shall be deemed severable and shall not affect the validity and enforceability of the remaining clauses of the Terms and Conditions. These Terms and Conditions set forth the entire understanding and agreement between you and us with respect to the subject matter hereof.

In the Company's sole discretion, it may transfer its rights and obligations (under these Terms and Conditions without your prior express consent). If you breach these Terms and Conditions, and the privacy policy or the documents they incorporate by reference and we take no action against you, we will still be entitled to use our rights and remedies in any other situation where you breach the aforesaid.

The Company may terminate these Terms and Conditions at any time. Without limiting the foregoing, the Company shall have the right to immediately terminate any passwords or accounts of the user in the event of any conduct by the user which the Company, in its sole discretion, considers to be unacceptable, or in the event of any breach by the user of these Terms and Conditions.
